When you order a luxury item from overseas on an e-commerce platform, it might fly from New York to Guangzhou on a Boeing 787. Unlike a maritime B/L, an Air Waybill (AWB) is not a document of title. It is more like a “transport service contract,” proving the legal relationship between the airline and the shipper, but cannot be freely transferred like a B/L. This characteristic sets the legal logic of air cargo transport apart from maritime transport.

The legal foundation of air cargo has evolved from the Warsaw Convention to the Montreal Convention. The 1929 Warsaw Convention was the cornerstone of air transport law, unifying liability rules for international air transport, but was criticized for low compensation limits and strict liability determinations. In the following decades, a series of protocols attempted amendments, leading to a fragmented legal system that confused practitioners.

The 1999 Montreal Convention finally ended this chaos. It integrated all prior Warsaw system instruments into a unified, modern legal framework. The most fundamental change was shifting carriers’ liability from “fault liability” to “strict liability”—carriers are liable for cargo loss during air transport unless they can prove the loss was caused by force majeure, inherent defects of the goods, or the shipper’s fault. It also significantly increased liability limits and introduced a “fifth jurisdiction,” allowing claimants to sue in their domicile, greatly facilitating rights enforcement.

In 2021, a shipment of precision medical equipment from Tokyo to London was damaged due to sudden pressure changes during transport. The cargo owner claimed compensation under the Montreal Convention. The airline attempted to defend itself on grounds of “inherent defects of the goods” but failed to provide sufficient evidence and was ordered to pay full compensation. This case clearly demonstrates the Montreal Convention’s strong protection of cargo owners’ rights and marks a profound shift in international air transport law from a “carrier-oriented” to a “cargo owner-oriented” approach.
