General Average vs Particular Average: The “Life-or-Death Choice” in Marine Insurance and Claim Logic 共同海损 vs 单独海损:海上保险的“生死抉择”与理赔逻辑
In the stormy Atlantic, a cargo vessel loaded with Chinese furniture encountered a rare tempest. To prevent capsizing, the captain ordered some cargo to be jettisoned into the sea. Who should bear the loss of this jettisoned cargo? This touches on the two core and often confused concepts in marine insurance: General Average (GA) and Particular Average (PA).
General Average refers to extraordinary sacrifices or expenditures intentionally and reasonably made to protect the common safety of the ship, cargo, and freight. It follows the ancient principle of “one for all, all for one,” requiring all beneficiaries (shipowner, cargo owners, freight payers) to share losses proportionally to the value of their respective interests. Particular Average, by contrast, is partial loss caused directly by natural disasters or accidents, affecting only one party’s interests, borne by the injured party or claimed from an insurer under the insurance contract.
In 2019, a container ship from Qingdao to Los Angeles ran aground in the Pacific, causing hull rupture and seawater ingress. To prevent sinking, the captain activated emergency pumps and hired a tugboat to tow the vessel to a nearby port for repairs. The electronic equipment damaged by seawater constituted particular average, compensated by the cargo owner’s insurer. The tugboat fees, emergency pump costs, and jettisoned cargo to lighten the ship, however, fell under general average, shared by all cargo owners and the shipowner.
In insurance claims, three basic coverages—Free from Particular Average (FPA), With Particular Average (WPA), and All Risks—have strict distinctions in covering these two types of losses. FPA only covers total or constructive total loss from natural disasters and particular average from accidents. WPA adds coverage for particular average from natural disasters. All Risks has the broadest scope, covering almost all losses from maritime perils, whether general or particular average, except for listed exclusions.
Understanding these concepts is not only a required course for insurance practitioners but also a key for foreign trade enterprises to avoid risks and make reasonable claims. When signing trade contracts, clearly stipulating insurance coverages and claim clauses ensures readiness in the face of “life-or-death choices.”

共同海损,是为了保护船、货、运费三方的共同安全,有意且合理地作出的特殊牺牲或支付的特殊费用。它遵循“一人为众,众为一人”的古老原则,所有受益方(船东、货主、运费方)必须按各自财产的价值比例分摊损失。而单独海损,则是因自然灾害或意外事故直接造成的、仅涉及某一方利益的部分损失,由受损方自行承担,或根据保险合同向保险人索赔。
2019年,一艘从青岛开往洛杉矶的集装箱船在太平洋触礁,船体破裂导致海水涌入。为了防止船舶沉没,船长启动了应急泵,并雇佣了拖轮将其拖至附近港口修理。其中,被海水浸泡的电子设备属于单独海损,由货主的保险公司赔偿;而拖轮费、应急泵使用费以及为减轻船重而抛弃的货物,则属于共同海损,由所有货主和船东共同分摊。
在保险理赔中,平安险、水渍险和一切险这三种基本险别,对这两种损失的承保范围有着严格的区分。平安险仅承保因自然灾害造成的全损或推定全损,以及因意外事故造成的单独海损;水渍险则在此基础上,增加了对自然灾害造成的单独海损的承保;而一切险的承保范围最广,除了列明的除外责任外,几乎涵盖了所有海上风险造成的损失,无论是共同海损还是单独海损。
理解这两个概念,不仅是保险从业者的必修课,更是外贸企业规避风险、合理索赔的关键。在签订贸易合同时,明确约定保险险别和理赔条款,才能在“生死抉择”面前从容不迫。
