Institute Cargo Clauses (London): The “Gold Standard” in Marine Insurance and Risk Decoding

In the international marine insurance market, the Institute Cargo Clauses (ICC) developed by the Institute of London Underwriters (ILU) are undoubtedly the undisputed “gold standard.” Since their introduction in 1982, the three coverages—ICC (A), (B), and (C)—have profoundly shaped the global marine insurance landscape with their rigorous logic, clear definitions, and wide applicability.

ICC (C) is the basic coverage with the narrowest scope, only covering cargo loss caused by major accidents (e.g., stranding, sinking, collision, fire, explosion) of the vessel, as well as general average and salvage charges. It acts as a “basic umbrella,” providing cargo owners with fundamental risk protection. ICC (B) expands on (C) to include coverage for natural disasters (e.g., earthquakes, volcanic eruptions, lightning) and loss from seawater, lake water, or river water entering the cargo hold. ICC (A), as “All Risks,” has the broadest scope, covering almost all losses from maritime perils—whether general or particular average—except for listed exclusions (e.g., war, strikes, inherent defects of goods, intentional acts of the insured).

In 2020, a shipment of soybeans from Brazil to China was damaged by mold due to water ingress into the cargo hold caused by severe weather. Since the cargo owner had ICC (A) coverage, the insurer paid full compensation under the clauses. If ICC (C) had been selected, compensation would only be available if the vessel suffered a major accident (e.g., stranding, sinking) due to severe weather. This case clearly illustrates the coverage differences between the clauses and highlights the importance of choosing the right insurance terms.

In addition to the core coverage clauses, the ICC includes a range of additional clauses, such as War Risks, Strikes Riots and Civil Commotions (SRCC), and Malicious Damage Clauses, allowing cargo owners to flexibly combine coverages to build personalized risk protection plans. This modular design enables the ICC to adapt to the complex and ever-changing international trade environment, making it the “universal language” of the global marine insurance market.

For foreign trade enterprises, a deep understanding of the Institute Cargo Clauses is not only a necessary means to avoid risks but also an important weight to enhance international competitiveness. When signing trade contracts, clearly stipulating the applicable insurance clauses and coverages ensures a solid “umbrella of protection” for goods in the volatile international market.
